John Fogerty got sued in the 80's because Old man down the road sounded too much like one of his old CCR tunes. He no longer owned the rights to his song and has been on the outs with the guy who does. In court Fogerty played both songs and said I sound like me. The case was thrown out of court.

Could you not argue that all music within a genre sounds the same? Hence the word genre?

I think we are talking about releasing the same song twice. Seriously, take my Bon Jovi post above, there is a youtube video of them both pllaying at the same time, and it is the same song!

Pendulum also does this, there are some tracks with the exact same phrasing, very slimilar note structure - just using slightly different synths.
A mate played me a clip of them double dropped together and it quite eerie how similar they are - for the life of me cant remember the track names though but i think they were 2 off the hold your colour album
Another trick is to keep the same intervals between the chords and just have it in a different key, eg:
