Default Kid Cudi stole Day 'n' Nite melody?

I just found a youtube vid, if you listen to the melody on the piano at 0:43 it's almost exactly the same as the basic melody of Day 'n' Nite. Do you guys agree? Please listen to it...

Basically every melody that appeals to the general public has been done/copied multiple times in some form or another so this really isn't a big deal.

Day n Nite was recorded in 2007.

Smoosh released She's Right in 2006 on the Free to Stay Album.

check the Amazon link for the audio clip (track 10)! - yup Dot the Genius sampled it - that's why it's called hip-hop.

if i remember correctly, day n nite wasnt originally professionally made, it was part of a home made mix tape, so you cant blame the guy too much

i could be completely wrong though

this goes on quite a lot with all music, but especially so with hiphop and dance music - after all, both evolved heavily out of sampling as one of the fundamental building blocks to their sound.

I wish the title of this thread didn't make it seem like a bad thing. People use music to make music, there's nothing wrong with that. Not to me anyway.
