    The rest I download legally (but with low bitrates, and I would never use them in public) or I get from friends who are DJ's (high bitrates). I never ask these friends where they get their music. It's sort of like how you don't ask questions about how the clothes you buy or the food you eat was produced, I guess.
    Have a look on soundcloud, many musicians (me included) provide their music under a creative-commons lisence and available for download. Some throw all of them out for free, some just a teaser every now and then. for example https://soundcloud.com/annie-mac-presents reposts free music every week. Famous artists like nico purman and flashmob have been on there.

    to answer your question: yes bitrate can lie, one can rip from a dusty record to tape, then to mp3@128kb/s and then burn it as wav, to be ripped by someone else, converted from wav to mp3 and uploaded as "320kb/s"
