well no disrespect but its not a very original logo so its not really a rip off.

I would argue that you are comparing apples and um....standard icons. I think this would be akin to an attempt to patent a star or the square root of -1. Though the i in Apple's case is very specific to that exact design of the font matrix. Could I get sued by Apple if I started a group of criminals called iCONs. Probably, but they would likely lose unless I used the same i in their patent.
EDIT:
I should clarify by saying, sure they could patent that specific design (if the TM on their T-shirt is actually a registered one). I can not seem to find the DJTT logotype that is similar to OP but IIRC DJTT is a bit more square button like. Depending on when each is patented there may be a case since their markets may have a bit of overlap. nvm found it--think they are dissimilar enough not to warrant legal action----but reeeeally pushing it though
