okay this is what im going through. its possible to sell the le with the tp2 upgrade? i haven't installed either.

I think you have to ask NI, but to obtain the free tp2 upgrade you need to install it first thru service center. then you get an email with the upgrade code.

Technically you're correct. You should be able to sell the LE and subsequent upgrade to Pro. You should contact support and get everything unregistered after it's all registered in your name before you take any money in case they have some kind of rule against selling software that was free.
