I have been reading alot on this blog. Very interesting stuff.
I searched the forum for “copyright” didnt find anything
My question is, how does it work with copyright? I mean wont i get sued if I put my own mixes on youtube?
I managed to find out that one is aloud to use copyrighted material for educational purposes, but how is that defined?
I live in Germany, and I assume I would get a lawsuit very quickly. How does it all work? Can anybody maybe give me tipp or a website where its understandable?
look at this, we tried to cover GEMA etc. Its quite informative, basically without permission you are not allowed to do anything with music, in example mixing, blending, sampling. Also no distributing on Youtube or alike. Its depressing.
I did some research on the GEMA website too, I cant believe it. Like nobody follows these rules, but I know that as soon as I go against these rules I will get f*ck, even if its non-profit. What a sad world we live in.
Do you know of any free-music portal or like gema-free portal?
There was once a Gigs & Mixes Forum on the Traktor Forum.
It was great , people posted mixes up made in Traktor. Happy Days.
Now of course making a DJ Mix from copyrighted music is illegal (in Europe) this is a fact. BUT we all know that it helps to promote artists and music in general. You hear a DJ mix, you think , yeah that tunes wicked and you go and buy it right?
The artist sells more tunes, DJs get their mixes played, everyone is happy.
Well NO.
The forum was shut down due to the legal threats from an German Dance artist because he found a link to a mix on the Traktor site that a remix of somebody elses track he had done.
The lawyers were brought in and the forum was trashed because NI have better things to do than fight legal battles with Germanys biggest firm of Music Lawyers.
Amongst all the argueing on the forum i asked the artist (numerous times) to just answer one question:
Have you lost any revenue due to the song being hosted in a DJ mix.
I never got an answer. The whole thing was about money after all or he wouldnt have had the mix pulled. Unfortunatly pulling the mix wasnt good enough for the artist, NI had to pull the whole forum.
I dont know if this artist has listened to mixes on DJTTs or any other forum so i guess there was something that made him go for NI.
Oh and worth adding the artist had previously sold over 10,000,000 records.
Yes you read right 10 MILLION. And he caused a world of trouble because of one remix in one DJ mix on a forum just for DJs.
Just shows, you never know who is listening to your mix:eek:
Check soundcloud, or mixcloud. You think anyone of those djs pays rights to post their mixes?
To be honest I think it’s ridiculous to pay rights unless you are selling the mix, or letting the people download it. As Karlos said, it only helps to promote the music.
If you check Lance’s website you can download his sessions, but hey all the tracks are from his own label.
For the most part as long as you are not selling the mix set no producer or label cares when the track is used. There is the exceptional jackass like Karlos stated above who will ruin that stuff for everyone. At any point you are selling the mix set producers and labels will not be happy and you are sure to get a call from a lawyer!!
not sure if u mean me? if u do then thanks for the plug!! Everything used in my sets are my own productions, from my label, or from friend’s promos and they are all wanting me to use them, which I gladly do to help push their music!
We should find out his name and make it very public what a jackass he is.
Germany is very serious about little things. Just turn on the tv and see how ****** police officers spend their days screwing ppl over for dropping a siggi on the floor. We pay taxes so that some ******* can go solve useless crimes, but hey thats drifting from the topic.
I think there might be more tollerance in Holland! They are more open-minded, and would more likly see that its promotion.
Creativity should be promoted instead of being prosecuted especially in a non-profit situation.
In generall Im happy im not the only one pi**ed off about things like these.
We should all get together and fight against these things somehow. Maybe we should just work harder on anonymunity and make it impossible for them to find us. We can all wear masks and upload videos on youtube via internet cafe’s.
I just saw a documentry the other day called “RiP: Remix Manifesto” you probably all know it, if not check it out.
First comment: no. This artist has every right to do what he did. No need to make fun of him because he made sure the law was enforced. Also, if he has sold 10 million copies already, he doesn’t need more ‘promotion’ and especially not by amateur DJs.
Second comment: Creativity should be promoted in a non-profit situation. But is this situation non-profit? No, because even though somebody might not be selling his work without royalties, the unknown dj IS getting the promotion, maybe get a gig or something. Which means money. no directly, yes indirectly
Finally, I know I’m a dick by saying this all and I know I upload mixes and I love everyone for doing it but if it is removed, you have no legal grounds to fight the removal. (and I agree with the law, for that matter)
I do not know the exact backgrounds to this case, but closing down a forum and probably sueing people when you already have money isnt the best way to go.
Im sure people suck off the fame, but there must be better ways to keeping these things fun, lifes not only about money, right?
If your mixes “only” get removed, thats acceptable. BUT when you get sued for thousands of euros, and lets say just an average Joe like me thats lives from paycheck to paycheck, its just depressing.
For him, maybe it was all about the money.
Besides that, ‘underground’ labels might like promotion but I’m sure large record companies already have headaches about mp3s being shared on internet for free, and then seeing yet another DJ using their music goes too far.
forgive me if i failed to read it in the details of the post but could someone please tell me if the song in question was legally purchased by the dj? was it a properly released track or was it a bootleg or something?
I’m in no way suggesting i agree with the forum having to be shutdown, just curious what got under this guys skin, surely his songs had been in countless other dj mixes of all calibers…
Like i said. The guy was well within his rights and no-one challenged that.
All i and other people wanted to know was:
A. Has he lost any revenue because of DJ mixes
B. How did he actually benefit from the action.
The artist is a DJ himself. Hes knows how the DJ world works.
This was about power and control over the forum not just about the money or creativity.
Doesnt matter if he sold 1 record or 10 million he was totally within his rights.
Its just that he never justified his reasons for the action and yeah maybe he didnt have to justify it but who on earth does something like that without having a good reason unless its just cus they want to cause trouble.
And trust me this caused a lot of trouble.
I only posted the story in response to the O.P… you never know who listens to your mix.
I really didnt want to re-hash this
AFAIK the track was legally bought. It was a remix of a MASSIVE dance hit and i mean HUGE, it sold 100s of 1000s of copies and is available on iTunes.
Everyone involved will have made a shit load of money.
The artists tracks are some of the biggest dance tunes in history. His tunes will have been in a million DJ mixes in the 90s.
It was a bit like Paul McCartney taking some pub band to court for recording a Death Metal version of “Yesterday”. Within his rights but pointless.
I was so pissed when that went down. There was a Traktor Forum mega mix in the works and it just disappeared. Something like 20 DJs from all around the world contributed, myself included. And then the forum just disappeared and I never heard anything about it again.
Dude did you not follow the long thread arguement that i had with the artist. It was EPIC.
It was before i was a Moderator so i was kinda off the leash so to speak.
I broke the first rule of arguing on a forum, Dont assume you know who you are talking to.
I told him that he would never amount to anything other than a DJ that plays at his sisters friends Sweet Sixteen parties.
Then i googled him (after i worked out who it was).
I kinda drifted from the forum RIGHT before it all went to shit so I missed the whole thing. That’s why I don’t know who you’re talking about.
But still man, it’s bullshit.
Pretty much this is how I’ve concluded copyright works in the music industry.
They aren’t actively looking. If they don’t see it in front of them they don’t give a shit, and they accept all the benefits. Technically you can’t even DJ in a nightclub without dues paid to the ASSCAP people, or whatever. If it’s licensed you need to pay. If you don’t pay then you can be sued and shut down.
But they won’t look for you. They won’t know til you’re making money and they take it all away and more.
